Excluding "trash" from searches/smart folders

It appears that items in my trash also appear in all matching searches and smart folders, and it's not at all obvious how to exclude "Trash" ... what am I missing?

    Hey mikejt, are you running the latest version? That issue was resolved a few months back. Please update to the latest version, and let me know if you are still experiencing the problem.
