Where is 3.9x for non MAS users? [Answered]
The agile bits license page clearly states
When you purchase AgileBits software your license will never expire and you can use it on the current version of the licensed application indefinitely. While the license itself will never expire, system updates from Apple could cause certain aspects of some software to stop working. For example, the Safari 5 upgrade stopped 1Password 2 from working correctly and required an updated version of 1Password.
Historically, AgileBits has been very generous with upgrades. Your purchase entitles you to free updates until the next major version upgrade. That means if you buy a license for version 2 of a product, you will get all 2.x releases for free, but upgrading to version 3 might require another purchase.
Please note that this upgrade policy is valid only for software sold and distributed directly by AgileBits. This policy is not applicable to software sold by other distributors, including the Mac App Store, iTunes App Store and Android Marketplace.

It seems as if you are not honoring your own policy for upgrades by not making the 3.9 releases available to non MAS purchasers. I'm sure that there are plenty of others who would like to utilize features such as Lion Fullscreen without repurchasing on the Mac App Store.

Yes, I am surprised that hasn't been a lot more ranting about this particular issue. I pointed this out in another thread and I was thinking that people would be up in arms about this point, but doesn't appear to be the case thus far as I have seen very little in this regard.Flag 0 -
Ah, what's in a name? <img src='http://forum.agilebits.com/public/style_emoticons/<#EMO_DIR#>/skype_smile.png' class='bbc_emoticon' alt=':-)' />
1Password 3.9 is a different branch of the 1Password 3 code. 1Password 3.8 still supports the same features that 3.9 does and is still compatible with Snow Leopard.
Also, I will draw your attention to the last paragraph of the license page quoted above:
